THE contract of Smartmatic with the Commission on Elections (Comelec) assures that the electronic voting systems provider can fend off any legal challenges it might face. The 24-page contract to supply the software and machines to automate the elections next year stipulates that “no motion for reconsideration shall be entertained” by the Comelec if any case is brought against Smartmatic by rival suppliers. It also allows Smartmatic to settle with the party questioning its deal with the Comelec to see to it that the poll automation project pushes through. Comelec and Smartmatic employees and personnel involved in the project are required to sign a non-disclosure agreement, assuring that the details of the project are shrouded in secrecy. Despite election fraud allegations, the Comelec awarded Smartmatic P1.04 billion in new contracts related to the 2022 elections.
